These Terms & Conditions (“Terms”) apply to bookings, purchases, tours, events, transportation services and experiences offered by Access Okanagan Events, Experiences & Tours Ltd. (“Access Okanagan,” “we,” “us,” or “our”).

By making a booking or purchasing a ticket through Access Okanagan, you acknowledge that you have reviewed and agree to these Terms and any additional terms disclosed for the specific tour, event or experience you purchase.

1. Our Services

Access Okanagan provides and arranges curated tours, events, transportation and experiences throughout the Okanagan region of British Columbia.

Experiences may include wine tours, brewery tours, golf experiences, dining events, lake experiences, cruises, entertainment, private transportation and other activities.

Certain components of an experience may be provided by independent third-party suppliers, including wineries, breweries, restaurants, golf courses, marinas, boat operators, transportation providers, venues, entertainers and other experience partners.

The specific inclusions for each booking will be identified in the applicable experience description or booking confirmation.

2. Bookings

All bookings are subject to availability.

A booking is considered confirmed once payment or any required deposit has been successfully processed and a booking confirmation has been issued by Access Okanagan or an authorized booking platform.

Customers are responsible for reviewing all booking information before completing their purchase, including:

  • experience selected;
  • date and time;
  • number of guests;
  • pickup or meeting location;
  • price, taxes and applicable fees;
  • experience-specific restrictions or requirements; and
  • cancellation and refund conditions.

The person making the booking is responsible for providing accurate information and for communicating applicable booking conditions to other members of their party.

3. Pricing and Payment

Unless otherwise stated, all prices are quoted in Canadian dollars (CAD).

Applicable taxes and mandatory charges will be disclosed during the booking process.

Payment must be made using one of the payment methods accepted by Access Okanagan or its authorized booking provider.

Access Okanagan reserves the right to correct obvious pricing or description errors before a booking is accepted. If an error is discovered after purchase and materially affects the booking, we will contact the customer to determine an appropriate resolution consistent with applicable law.

4. Cancellations and Refunds

Unless different terms are clearly disclosed for a particular tour, event or experience, our standard cancellation policy is:

7 days or more before the scheduled experience:
100% refund of the amount paid.

Between 72 hours and 7 days before the scheduled experience:
50% refund of the amount paid.

Less than 72 hours before the scheduled experience:
Non-refundable.

No-shows:
Non-refundable.

Certain limited-capacity events, special events, concerts, dining experiences, cruises, private experiences and other products may have different cancellation or refund conditions. Where different conditions apply, they will be disclosed as part of the applicable booking.

Nothing in these Terms limits any cancellation, refund or other consumer right that cannot legally be waived under applicable law.

Please review our separate Cancellation & Refund Policy for additional information.

5. Minimum Guest Requirements

Certain tours, events and experiences require a minimum number of participants to operate.

Where a minimum participation requirement applies, it may be identified in the applicable experience description.

If the required minimum is not reached, Access Okanagan may cancel or, with the customer's agreement, reschedule the experience.

If Access Okanagan cancels an experience because the minimum participation requirement has not been met, customers will be offered a full refund of the amount paid for the cancelled experience or the opportunity to transfer their booking to another available date or experience.

6. Changes to Tours, Events and Experiences

Access Okanagan works with multiple suppliers to create curated experiences.

It may occasionally be necessary to modify an itinerary, timing, vehicle, vessel, venue, supplier, activity, menu or other component because of weather, safety considerations, availability, operational requirements or circumstances outside our reasonable control.

Where a material component becomes unavailable, Access Okanagan will take reasonable steps to provide a suitable alternative or other appropriate remedy.

7. Weather and Safety

Some Access Okanagan experiences are weather-dependent.

Lake conditions, wildfire conditions, snow, extreme weather, road closures or other safety considerations may result in an experience being modified, postponed or cancelled.

Safety decisions made by Access Okanagan or an applicable operator, captain, driver, venue or supplier must be respected.

Where Access Okanagan cancels an experience entirely, the customer will be offered a refund or, where agreed with the customer, an alternative date or experience, subject to applicable law and any experience-specific terms.

8. Transportation

Transportation may be provided by Access Okanagan or an appropriately authorized third-party transportation provider, depending on the experience purchased.

Guests must be ready at their designated pickup location at the communicated time.

Pickup and arrival times may be affected by traffic, weather, road conditions, closures, guest delays and other circumstances outside our reasonable control.

Guests must comply with applicable laws and reasonable instructions from drivers and transportation providers.

Seatbelts must be worn where required.

9. Alcohol

Certain Access Okanagan tours and experiences involve wineries, breweries, restaurants, bars or alcoholic beverages.

Guests consuming alcohol must meet the applicable legal drinking-age requirements and may be required to present valid government-issued identification.

The service of alcohol is controlled by the licensed establishment or authorized provider serving the alcohol.

Access Okanagan cannot guarantee that alcohol will be served to any individual. Licensed establishments may refuse service where required or permitted by law.

Guests are expected to behave responsibly. Unsafe, threatening, abusive, excessively intoxicated or disruptive behaviour may result in removal from an experience where reasonably necessary for the safety of guests, employees, suppliers or the public.

10. Lake and Boating Experiences

Certain experiences may involve travel aboard boats or other watercraft operated by Access Okanagan partners or independent operators.

Guests must comply with all instructions provided by the vessel's captain, crew and operator.

Lake experiences may be modified, delayed or cancelled because of weather, water conditions, mechanical issues or safety considerations.

Where applicable, guests must comply with requirements concerning personal flotation devices and other safety equipment.

11. Third-Party Suppliers

Access Okanagan partners with independent businesses to deliver components of certain experiences.

These may include wineries, restaurants, breweries, golf courses, boat operators, transportation companies, venues, entertainers and other suppliers.

Third-party suppliers may maintain their own safety requirements, rules and conditions applicable to services they directly provide.

Nothing in these Terms is intended to exclude or limit responsibility or liability where doing so would be prohibited by applicable law.

12. Guest Conduct

Access Okanagan is committed to providing a safe and enjoyable experience for guests, employees and partners.

Guests may be refused participation or removed from an experience for conduct that creates a material safety risk or includes threatening, abusive, violent, illegal or seriously disruptive behaviour.

Where removal results from the guest's own prohibited conduct, the guest may not be entitled to a refund, subject to applicable law.

13. Late Arrivals and Missed Experiences

Guests are responsible for arriving at the specified meeting or pickup location at the communicated time.

Because many experiences involve scheduled reservations with multiple suppliers, we cannot guarantee that an experience can be delayed for a late guest.

Guests who miss their scheduled departure because of their own late arrival may be considered a no-show.

14. Accessibility, Dietary and Special Requirements

Guests are encouraged to contact Access Okanagan before booking if they have accessibility requirements or require particular accommodations.

For experiences involving food or beverages, guests should disclose relevant dietary requirements and allergies in advance.

Access Okanagan will make reasonable efforts to communicate accommodation requests to applicable suppliers but cannot guarantee that every supplier, venue, vehicle, vessel or activity can accommodate every request.

15. Personal Property

Guests are responsible for their personal belongings during an experience.

Access Okanagan is not responsible for personal property that is lost, forgotten, stolen or damaged except to the extent responsibility cannot lawfully be excluded.

Guests should contact us promptly regarding items believed to have been left in a vehicle or at an experience.

16. Damage to Property

Guests may be responsible, to the extent permitted by law, for reasonable costs arising from property damage caused intentionally or negligently by the guest.

This may include damage to vehicles, vessels, equipment, venues or property belonging to Access Okanagan or participating suppliers.

17. Assumption of Ordinary Risks

Some experiences involve inherent risks associated with travel, transportation, boating, outdoor activities, weather conditions and other recreational activities.

Guests are responsible for determining whether an activity is suitable for them and for following all safety instructions provided by Access Okanagan and applicable suppliers.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

18. Force Majeure

Access Okanagan will not be responsible for a failure or delay in providing an experience where performance is prevented by circumstances outside its reasonable control.

Such circumstances may include severe weather, wildfire, natural disasters, road closures, government orders, emergencies, labour disruptions, utility failures or unexpected closure of an essential supplier.

Where such circumstances materially affect a booking, Access Okanagan will address rescheduling, alternatives, credits or refunds in accordance with the applicable booking conditions and applicable law.

19. Photography and Media

Access Okanagan may photograph or record certain events and experiences.

Where Access Okanagan wishes to use an identifiable guest's image or likeness for promotional or marketing purposes, appropriate consent will be obtained where required.

Guests who have concerns regarding photography should contact Access Okanagan.

20. Privacy

Personal information collected through our website, booking systems and experiences is handled in accordance with our Privacy Policy and applicable privacy law.

Information may be shared with participating service providers where reasonably necessary to administer and fulfil a customer's booking.

21. Website Information

Access Okanagan makes reasonable efforts to ensure that descriptions, photographs, prices and other information displayed on its website are accurate.

Photographs may be illustrative, and specific vehicles, vessels, food items, beverages, venues or other experience elements may vary where substitutions are reasonably necessary.

22. Promotions, Discounts and Membership Benefits

Promotional codes, discounts, member pricing and special offers may be subject to additional conditions, availability, booking windows and expiry dates.

Unless otherwise stated, promotional offers cannot be combined.

Access Okanagan reserves the right to discontinue or modify promotional programs prospectively, subject to existing confirmed bookings and applicable law.

23. Gift Cards and Credits

Gift cards, booking credits or promotional credits, where offered, are subject to the conditions disclosed when issued and applicable British Columbia law.

24. Changes to These Terms

Access Okanagan may update these Terms periodically.

Changes will apply prospectively from the effective date shown on this page and will not retroactively alter the agreed terms of an existing confirmed booking except where permitted by law or agreed with the customer.

25. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.

Nothing in these Terms limits rights or remedies available to consumers under applicable law that cannot legally be waived or restricted.
